Ouahbi promises a digital platform

The Minister of Justice, Abdellatif Ouahbi, announced last Monday in the House of Representatives the imminent establishment of a digital platform to monitor and supervise the execution of judgments pronounced against insurance companies. This new mechanism will help to identify malfunctions and deal with the delays recorded as soon as possible, the minister explained to the parliamentarians.

“A new digital platform will soon be online to supervise the execution of judgments against insurance companies”, announced the Minister of Justice, Abdellatif Ouahbi, who spoke last Monday during the oral question session organized in the House of Representatives. According to the same manager, this project will be carried out in partnership with insurance companies. Concretely, it will be a question for the Ministry of Justice to register all the judgments issued by the various courts of the Kingdom against the insurance companies, which will allow to have a traceability on the evolution of each file and to identify malfunctions in case of delay in execution. As for the courts, their mission will be to execute judgments.

As for the partner insurance companies, they undertake to pay compensation and damages as soon as possible, according to the details provided by the Minister. “The implementation of this platform will solve the major problem relating to the delay observed in the execution of judgments against insurance companies. Indeed, we have noted that some judgments issued in 2022 have been executed, while others, dating from 2016, were still taking a long time to be executed, which raises several questions about the reasons for this delay, “said the Minister. who noted that the establishment of this platform will also make it possible to resolve the challenge relating to “territorial belonging”. He affirmed, in this sense, that in the current state of things, the courts proceed to a delegation of the execution of the judgments in case the insurance company would not be in the same city of the court. A constraint which will now be overcome with the establishment of this platform which will have a national character.

On another note, the Minister announced that his department will work over the next year on the revision of the scale of compensation granted by these companies, recognizing that the amounts of current compensation remain very low and do not sometimes exceed 20,000 to 40,000 DH in the event of death. “We already held a meeting three months ago with the representatives of the insurance companies and the representative of the National Health Insurance Agency to prepare the launch of the platform. Nevertheless, we will have much more time to initiate the reform of the scale of compensation granted by these companies. This is why we have decided to start this project next year after the examination and adoption of the bill relating to judicial procedure which currently requires all attention”, concludes the Minister.
